Rubio, Menendez Introduce Legislation to Create Tax Equity for Families Living in Puerto Rico
Miami, FL- U.S. Senators Marco Rubio (R-FL) and Bob Menendez (D-NJ) yesterday introduced bipartisan legislation to ensure parents living in Puerto Rico are entitled to the same tax break given to families living on the mainland. The Child Tax Credit Equity for Puerto Rico Act of 2019 would correct a long-standing discrepancy in the federal tax code that denies Puerto Rican families with one or two children access to a tax benefit they would otherwise be entitled to had they lived on the U.S. mainland.
“Giving Puerto Rican families equal treatment for the Child Tax Credit is long overdue,” Rubio said. “I am proud to join this bipartisan effort for island families.”
“There is zero justification for treating any American citizen as second class based solely on their zip code, let alone when we are talking about the ability for struggling families to care for their our children,” Menendez said. “Extending the child tax credit benefit to Puerto Ricans with one or two children will provide these families with much needed relief. Putting more money in people’s pockets will help make families more financially secure and stimulate the local economy at a time when Puerto Rico is still recovering from the devastation caused by Hurricane Maria.”
The Child Tax Credit Equity for Puerto Rico Act of 2019 amends Section 24 of the tax code and would provide nearly $273 million to families living on the island, helping to reduce poverty and stimulate spending to help local businesses. Recent studies show children, whose families receive child tax credit, do better in school and are more likely to attend college.
Puerto Rico has the highest poverty rate of anywhere in the United States, according to census data, with the lowest household income, $19,518, and the majority of children on the island living near or under the poverty level, with 39% considered extremely poor.
Key Rubio Provisions in support of the Child Tax Credit for Puerto Ricans:
- On May 17, 2018, Rubio and Senator Hatch introduced legislation to promote stability and prosperity in Puerto Rico. The Puerto Rico Economic Empowerment Act of 2018 (S. 2873) included the Child Tax Credit.

“Darle a las familias de Puerto Rico un trato equitativo en el Crédito Contributivo Federal es una tarea pendiente,” Rubio dijo. “Me enorgullece ser parte de este esfuerzo bipartidista por las familias de la isla.”
“No hay justificación para perpetuar el trato de los ciudadanos estadounidenses como ciudadanos de segunda clase, mucho menos cuando estamos hablando de nuestros niños,” Menéndez dijo. “Extender los créditos fiscales a puertorriqueños con uno o dos hijos les dará a miles de familias el alivio que necesitan. Esto también ayudará a poner más dinero en el bolsillo esas familias y estimular la economía local en un momento en el que aún se recuperan del huracán María.”
El proyecto de ley enmienda la sección 24 del código tributario y daría cerca de $273 millones a las familias que viven en la isla, ayudando a reducir la pobreza y estimulando la economía de negocios locales. Estudios recientes demuestran que los hijos de familias que reciben este tipo de incentivos tienen un mejor desempeño en la escuela y tienen más posibilidades de continuar su educación.
Puerto Rico tiene una de las tasas de pobreza más altas de los Estados Unidos, de acuerdo con datos del Censo. Cerca del 60% de los niños en la isla viven por debajo el índice federal de pobreza.
