English/ Español: Rubio, Warnock Introduce Bill to Protect Americans’ Sensitive Personal Data
Washington, D.C. — U.S. Senators Marco Rubio (R-FL) and Raphael Warnock (D-GA) introduced the Protecting Sensitive Personal Data Act, legislation to expand the U.S. Department of the Treasury’s Committee on Foreign Investment (CFIUS)’ oversight authority of transactions involving Americans’ sensitive personal data. The legislation would protect important personal information, such as genetic test results, health conditions, insurance applications, financial hardship data, security clearance information, geolocation data, private emails, data for generating government identification, and credit report information.
“Americans should be deeply concerned about foreign investments in U.S. companies that handle their personal information, which pose a risk of exposing personal data, like genetic testing results and private financial transactions, to harmful actors in China and elsewhere,” Rubio said. “We need to strengthen CFIUS’s oversight authority of these transactions to protect Americans and mitigate this serious national security threat.”
“We must do everything in our power to protect the personal data and information of our constituents and governmental agencies from foreign entities that may wish to exploit them,” Warnock said. “I’m glad to work with Senator Rubio to strengthen our defenses against these dangerous security breaches.”
Background: Currently, there are limited circumstances in which CFIUS is able to require companies to make a mandatory declaration prior to completing a transaction. This legislation would expand CFIUS’ authority to issue regulations that require mandatory declarations to foreign investments in U.S. companies that handle sensitive personal data, increasing critical oversight. Foreign investment is one of the legal means that adversaries, like the People’s Republic of China, uses to stockpile Americans’ healthcare data, creating both privacy and national security risks.
RUBIO, WARNOCK PRESENTAN LEGISLACIÓN PARA PROTEGER DATOS SENSIBLES Y PERSONALES DE LOS NORTEAMERICANOS
Washington, D.C. — Los senadores estadounidenses Marco Rubio (R-FL) y Raphael Warnock (D-GA) presentaron un proyecto de ley para expandir una legislación existente para que el Comité de Inversión Extranjera del Departamento del Tesoro de EE.UU. (CFIUS, por sus siglas en inglés) tenga la autoridad de supervisar transacciones que involucren datos personales y sensibles de los norteamericanos. La legislación protegería información personal importante, como: los resultados de pruebas genéticas, condiciones de salud, solicitudes de seguros, datos sobre dificultades financieras, información sobre autorizaciones de seguridad, datos de geolocalización, correos electrónicos privados, datos para generar una identificación gubernamental e información de informes crediticios.
“Los estadounidenses deberían estar profundamente preocupados por las inversiones extranjeras en empresas americanas que manejan su información personal, lo que representa un riesgo al exponer datos personales, como resultados de pruebas genéticas y transacciones financieras privadas, a actores dañinos en China y en otros países”, Rubio dijo. “Necesitamos fortalecer la autoridad de supervisión del CFIUS en este tipo de transacciones, para así poder proteger a los norteamericanos y mitigar esta grave amenaza a nuestra seguridad nacional”.
